Besti Health ("Service") is provided by Besti Co. ("Company," "we," "our," or "us"), headquartered in Louisville, Kentucky. The Service provides healthcare professionals with AI-powered tools for generating clinical documentation including SOAP notes using AWS HealthScribe and related features such as PDF population, document management, and clinical workflow optimization.
By creating an account, accessing, or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, you must not use the Service.
2. Eligibility and Account Requirements
Eligibility:
The Service is intended exclusively for licensed healthcare professionals and related healthcare organizations
You must be at least 18 years old to create an account
You must be authorized to use AI documentation tools in your jurisdiction
You represent that you have the necessary professional licenses and credentials to practice healthcare
Account Security:
You are solely responsible for maintaining the confidentiality of your login credentials
You must immediately notify us of any unauthorized use of your account
We reserve the right to suspend accounts that show signs of suspicious activity
3. Account Management
Registration:
You must register with a valid professional email address
All account information must be current, complete, and accurate
You must promptly update any changes to your professional credentials or contact information
Account Termination:
Accounts may be terminated at any time upon request by emailing info@bestihealth.com
We may suspend or terminate your account for violations of these Terms
Upon termination, your data will be handled according to our data retention policies
4. Payments and Billing
Subscription Services:
Subscription fees are processed through Stripe, our third-party payment processor
We do not store credit card or billing information
Fees are subject to change with 30 days' advance notice
Refund Policy:
All payments are generally non-refundable unless required by law
Pro-rated refunds may be provided for service outages exceeding 24 hours
Refund requests must be submitted within 30 days of the billing date
5. User Responsibilities and Acceptable Use
Professional Obligations:
You agree to use the Service in accordance with applicable healthcare laws and professional standards
You remain solely responsible for all clinical decisions and patient care
You must obtain appropriate patient consent for using AI documentation tools where required by law
Prohibited Activities:
You agree not to:
Misuse the Service or attempt to access data outside your account scope
Upload unlawful, infringing, or harmful content
Use the Service for non-healthcare or unauthorized purposes
Share your account credentials with unauthorized individuals
Attempt to reverse engineer or circumvent security measures
Use the Service in a manner that could damage our reputation or business
6. AI Technology and Accuracy Disclaimers
AI Limitations:
The Service uses artificial intelligence which may occasionally produce inaccurate or incomplete results
All AI-generated content must be reviewed and approved by a qualified healthcare professional
You acknowledge that AI technology may experience "hallucinations" or generate incorrect information
We continuously work to improve accuracy but cannot guarantee error-free performance
Professional Responsibility:
Final responsibility for all clinical documentation and decisions rests solely with you
The Service is designed to assist, not replace, professional medical judgment
You must verify all AI-generated content before use in patient care
7. Data Retention, Backup, and Deletion
Data Retention:
Clinical notes and documentation are retained for up to 30 days by default
Extended retention periods may be available upon request
You may delete your data at any time through your account settings
Backup and Recovery:
After deletion, data may remain in encrypted backups for up to 90 days before permanent removal
We maintain backup systems to protect against data loss
Data recovery requests may be accommodated within the backup retention period
8. Intellectual Property Rights
Our Rights:
We retain all rights, title, and interest in the Service, including software, designs, algorithms, and trademarks
The Besti Health name, logo, and branding are our exclusive property
Your Rights:
You retain ownership of all data and documents you upload to the Service
You grant us a limited license to process your data solely to provide the Service
This license terminates when you delete your data or close your account
9. HIPAA Compliance and Healthcare Regulations
HIPAA Compliance:
We maintain HIPAA compliance and execute Business Associate Agreements (BAAs) with all relevant vendors
Our infrastructure meets or exceeds HIPAA security and privacy requirements
We conduct regular compliance audits and security assessments
Your Responsibilities:
You are responsible for obtaining patient consent where required before uploading PHI
You must ensure your use of the Service complies with all applicable healthcare regulations
You should maintain appropriate documentation of consent and authorization
10. Security and Data Protection
Technical Safeguards:
All data is encrypted at rest using AES-256 encryption
Data in transit is protected using TLS 1.2 or higher
Access to PHI is restricted to authorized roles only with comprehensive audit logging
Organizational Safeguards:
Employees handling PHI undergo annual HIPAA training and background checks
We maintain incident response procedures for potential security breaches
Access controls are regularly reviewed and updated
11. Service Availability and Support
Service Level:
We strive to maintain 99.5% uptime for the Service
Planned maintenance will be scheduled during off-peak hours with advance notice
We provide technical support during standard business hours
Limitations:
The Service is provided "as is" without warranties of any kind
We do not guarantee error-free or uninterrupted service
Service availability may be affected by factors beyond our control
12. Limitation of Liability and Indemnification
Liability Limitations:
To the fullest extent permitted by law, Besti Co. shall not be liable for indirect, incidental, or consequential damages arising from use of the Service
Our total liability is limited to the amount of fees paid in the 12 months preceding the claim
This limitation does not apply to gross negligence or willful misconduct
Mutual Indemnification:
You agree to indemnify us against claims arising from your misuse of the Service
We will indemnify you against claims arising from our gross negligence or willful misconduct
13. Governing Law and Dispute Resolution
Governing Law:
These Terms are governed by the laws of Kentucky, United States
Any disputes will be resolved through binding arbitration in Louisville, Kentucky
You may opt out of arbitration within 30 days of account creation

We may update these Terms at any time with reasonable notice

Users will be notified by email and in-app notice of material changes
